Interpretation

a.

“BUYER” means the person who accepts a quotation of the Seller for the sale of the Goods or whose order for the Goods is accepted by the Seller.

b.

“GOODS” means the product or any part of them which the Seller is to supply in accordance with these Conditions.

c.

“SELLER” means Mr. Podenco registered in The Hague, the Netherlands.

d.

“CONDITIONS” means the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) includes any special terms and conditions agreed in writing between the Buyer and the Seller.

e.

“CONTRACT” means the contract for the purchase and sale of the Goods

f.

“CONFIDENTIAL INFORMATION” means reports; drawings; designs, documents; technical, scientific and commercial data and any other information marked “confidential” supplied by one party to the other.

Article 1 – Introduction

The Conditions outlined herein are applicable on all orders placed through the web-shop or any other sales outlet of the Seller. By placing an order or a commissioned article you agree to accept all Conditions. The Seller reserves the right to change the Conditions at any time. These Conditions have been drawn up on 20th August 2018.

Article 3 – Applicability

3.1

These Conditions are applicable to any offer of the Seller and any agreement made between the Seller and its Buyer.

3.2

Before any agreement is made, the Conditions will be made available to the Buyer via the website www.mrpodenco.com.

3.3

Any offer will also refer to the Conditions.

The Contract and the present Conditions for the Sale of the Goods shall be governed by, and construed and enforced in accordance with the law of the Netherlands.

Article 4 – The offer

4.1

Clear descriptions of the Goods are available with each article for sale. The colours of the pictures of the Seller’s products may vary to the chosen product. This is related to the varying colour profiles of camera lenses. Nonetheless, the Seller endeavours to provide an accurate description of all Goods and is prepared to send additional photographs via Messenger or other media to provide more details.

4.2

All pictures, photographs and texts, hereafter referred to as “Content” are proprietary to the Seller. Any Content may not be copied or used for any other purposes in whichever form world-wide without the permission of the Seller.

4.3

This also applies to the pictures and designs which are created on the Seller’s products.

4.4

Any form of copying of such Content is not allowed without written permission. In case of violation, one would be in violation of trademark law.

Article 5 – The order and/ or Commission Goods

5.1

Following the order of the Seller’s product you will receive an order confirmation by email. These may be sent automatically or manually and may cause a slight delay, but never more than 24 hours.

5.2

Should you have not received your email within 24 hours of the order, nor in your junk folder, please contact us via email at info@mrpodenco.com.

5.3

Should you have any problems when placing your order in the web-shop, you may place your order by email to: info@mrpodenco.com. Please clearly state the nature of your order, the product, the url to the product and a confirmation that you will make the payment in full following the first contact. Upon receipt of the payment, your order will be processed.

5.4

The Seller also develops, in mutual agreement, Commissioned Goods as per your wishes. Delivery times, additional terms and conditions and price agreements for products will also occur in agreement with the Buyer.

5.5

Commissioned Goods will be accepted upon receipt of 50% of the agreed price (excluding VAT).

5.6

Commissioned Goods are excluded of the right of return, as mentioned in Article 8.

Article 6 – Returns as per the Right of Return

You have the right to return your ordered Goods within 14 days upon receipt of your order, with the exception of the in Article 5 stipulated “Commissioned orders”. The Seller may demand the reason for the return, however you are not obliged to provide it. In Article 7 you will find the Conditions regarding returned Goods.

Article 7 – Obligations of the Buyer during the cooling off period

7.1

During the cooling off period of 14 days as mentioned in Article 6, the Buyer will take good care of the Goods and the original packaging. The Buyer shall only unpack the Goods to inspect and handle the Goods.

7.2

Should the Buyer opt to make use of right to return, the Buyer should inform the Seller in writing by email to the Seller within 14 days of receipt of the Goods at info@mrpodenco.com.

7.3

The email should contain clear written information as to when the Goods were purchased, by whom and the time period in which the Seller wishes to return the Goods. The Buyer shall return the Goods the day following the declaration in writing to the Seller to the address outlined in the Conditions.

7.4

The Buyer shall send the Goods as sent, with original packaging and in good order.

7.5

All risks and proof of burden of the Conditions related to the cooling off period and right to return lies with the Buyer. The Seller is not liable for theft of the Goods during the delivery or return of the Goods.

7.6

Postage costs associated with a return of the Goods are for the Buyer, all returns should be sent with registered post with a track and trace number. This track and trace number shall be communicated in writing by email to the Seller at the time of sending to assure a safe and timely receipt of the returned Goods. Choice of courier is the Buyer’s responsibility.

7.7

As soon as the returned Goods have been inspected and deem to be in good order, the purchase cost will be returned within 14 days to the account number which is known with the Seller. If the purchase was done in cash, the Buyer shall provide a valid bank account number within the Netherlands, including a copy of a valid proof of identity of the account holder.

Article 8 – Exclusion of the right of return

For Commissioned Goods which have been created in accordance to the specifications and request of the Buyer, which are not pre-fabricated and are created following a specific request of the Buyer, the Seller reserves the right to exclude these from the right to return of Goods during the cooling off period. These Goods include but are not limited to the Seller’s bags created on commissioned requests and all Seller’s screen-prints which have been created upon request, regardless of the materials used. Also known as “Commissioned Goods”.

Article 9 – Pricing of the Goods

All prices of the Goods on the Seller’s website are in Euros, including 21% VAT and excluding postage costs. Prices of Goods on the website are subject to change. No rights can be derived from this. Not even as a direct result from a typing error or error caused by computer software or a technical malfunction of any kind. After the purchase amount has been credited to the bank account of the Seller, the Seller will send the Goods and, or, Commissioned Goods as mentioned in article 5.

A percentage of the proceeds will be donated to the Foundation Dawn tail Dusk. The goal of this Foundation is to promote well-being for people and animals in the Netherlands and abroad.

Article 10 – Payment

10.1

Payments must be made in advance. This can be done through payment by iDEAL (bank account), credit card or PayPal. The Seller shall deliver the Goods upon receipt of full payment. The delivery time starts at the time that the Seller has received the payment.

10.2

Article 11 – Complaints procedure and warrantees

11.1

DAll Seller’s Goods are created with passion and love. It is possible that something does not go according to plan. A complaint can be raised by sending an email to info@mrpodenco.com.

11.2

Contrary to the right of return referred to in articles 6 and 7, the Buyer has the right to report any complaint within two months after finding a defect. If the defect falls within the warranty, it will be repaired free of charge or even replaced.

11.3

Submitted complaints will be answered within a period of 14 days.

11.4

If a complaint requires longer processing time, the Buyer will be duly informed about this. The sender also receives a confirmation of receipt within 24 hours after sending the complaint or question.

Article 12 – Cleaning advice (washing instructions)

All Seller’s Goods are handmade from various materials and products. Materials such as leather are not washable. Goods in which leather is processed can therefore not be washed in a washing machine.
Tote bags and dog bandanas that are hand-printed may be washed in the washing machine, preferably in a washing net and if possible inside out, to be washed at 30 degrees Celsius. After washing, pull the Goods into shape and let it dry flat, for example on a drying rack. A tote bag cannot be dried in the dryer. Preferably iron the Goods with a protective cloth or baking paper as an extra layer over the image. If you want to enjoy the Goods longer, it is preferable to always wash it by hand.
